Termination

Resignation and Dismissal

When an employer dismisses an employee it must be with just cause and they must give them notice. The notice period starts from the day after the employer notifies the employee of the termination. Notice must be given in accordance with the following schedule at a minimum:

Notice periods

30 days’ notice for one year’s service, increasing to 45 after one year, 60 after five and 90 days after ten years’ service.

Severance

If an employee is made redundant, they are entitled to a payment based on years of continuous service.

Unjustified Severance

If the dismissal is deemed unjustified, the employee is entitled to compensation determined by the Judge or Court, with the amount not exceeding the wages the employer would have paid until the end of the contract.
